6. Data subjects’ rights
Pursuant to Articles 15–22 of the GDPR, the User, as a data subject, may exercise specific rights by contacting the Controller, including:
- right of access: the right to obtain from the Controller confirmation as to whether or not personal data concerning them is being processed and, where that is the case, access to the personal data and the following information:
- (i) the purposes of the processing;
- (ii) the categories of personal data concerned;
- (iii) the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
- (iv) where possible, the envisaged period for which the personal data will be stored or, if not possible, the criteria used to determine that period;
- (v) the right to lodge a complaint with a supervisory authority;
- (vi) where the data are not collected from the User, any available information as to their source;
- (vii) the existence of automated decision-making, including profiling, and meaningful information about the logic involved and the expected consequences of such processing (Art. 15 GDPR);
- right to rectification: the right to obtain from the Controller without undue delay the rectification of inaccurate personal data concerning them and, taking into account the purposes of the processing, to have incomplete personal data completed, including by means of providing a supplementary statement (Art. 16 GDPR);
- right to erasure: the right to obtain from the Controller the erasure of personal data concerning them without undue delay where:
- (i) the personal data are no longer necessary in relation to the purposes for which they were processed;
- (ii) the data subject withdraws consent and there is no other legal basis for processing;
- (iii) the data subject objects to the processing and there are no overriding legitimate grounds for the processing;
- (iv) the personal data have been unlawfully processed;
- (v) the personal data must be erased to comply with a legal obligation (Art. 17 GDPR).
- right to restriction of processing: the right to obtain restriction of processing where:
- (i) the accuracy of the personal data is contested, for the period necessary for the Controller to verify the accuracy of such data;
- (ii) the processing is unlawful and/or the data subject has objected to the processing;
- (iii) the data are required for the establishment, exercise, or defense of legal claims;
- (iv) the data subject has objected to processing, pending verification of whether the Controller’s legitimate grounds override those of the data subject (Art. 18 GDPR);
- right to data portability: the right to receive the personal data concerning them, which they have provided to the Controller, in a structured, commonly used, and machine-readable format, and to transmit those data to another controller without hindrance, where the processing is based on consent or a contract and carried out by automated means only (Art. 20 GDPR).
The User has the
right to object, in whole or in part, on grounds relating to their particular situation and in the cases provided for by the GDPR, to the processing of personal data concerning them (Art. 21 GDPR).
Without prejudice to any other administrative or judicial remedy, Users who believe that the processing relating to them infringes the GDPR have the
right to lodge a complaint with the competent supervisory authority as provided for by Article 77 GDPR.
